Government service me transfer normal administrative tool hai – workload balance, staffing needs, public interest. Problem tab aati hai jab transfer actually hidden punishment ban jaye – inconvenient remote posting as reaction to complaint, union activity, ya refusal to obey illegal order.

Courts usually kehte hain ki transfer policy domain of employer hai, but they can interfere if:

  • Transfer clearly mala fide lagta hai,
  • Same person baar-baar har sensitive case ke baad dur bhej diya jaata hai,
  • Mandatory guidelines (tenure, spouse posting, etc.) grossly violated hain.

Documented past events, timing, and comparative treatment sab se mala fide prove ki ja sakti hai.

Employee ko har transfer pe straight court nahi daudna chahiye, lekin jab pattern abuse ka ho, tab judicial review ek legitimate option hai.
