Right to Privacy in the Digital Age

Phone location, browsing history, facial recognition cameras, UPI patterns – digital age me privacy ka matlab sirf “ghar ki char dewari” nahi raha. Courts ne clearly recognise kiya hai ki privacy ek fundamental right hai, lekin absolute nahi.

Government surveillance, data collection, KYC norms, and security laws ka constant tension rehta hai rights ke saath. Legal test broadly yeh hota hai:

  • Kya law clear aur specific hai,
  • Kya legitimate aim hai (national security, crime control, etc.),
  • Kya measure necessary aur proportionate hai,
  • Kya safeguards, oversight, review mechanisms exist karte hain.

Private companies ke liye data protection frameworks aa rahe hain – consent, purpose limitation, storage limits, breach notification. Users ko bhi apne digital hygiene pe dhyan dena padega – random apps ko unlimited permissions dena, open Wi-Fi pe banking karna, sab risk increase karta hai.

Right to privacy ka future issi balance se judge hoga – innovation aur security vs human dignity aur autonomy.
