Kabhi-kabhi hum kisi ko house ya shop me caretaker, manager ya licencee ke roop me rakh dete hain – rent agreement nahi hota, bas “dekh-bhaal kar lo” type understanding hoti hai. Problem tab shuru hoti hai jab woh person wapas jaane se mana kar deta hai.
Legally, licencee ke paas possession ka right nahi, sirf permission hoti hai. Jab licence terminate ho jaye, to owner normal civil suit file karke possession wapas maang sakta hai. Court dekhegi:
- Relationship nature – lease thi ya licence,
- Kya koi written document hai,
- Kab tak permission di gayi thi,
- Kya owner ne timely objection kiya.
Licencee kabhi-kabhi ownership ya tenancy claim karne ki koshish karta hai. Isliye shuru se hi written “Leave & Licence / Caretaker” type simple document banana safe hota hai.
Delay sabse bada risk hai – jitna zyada time aap chup rahoge, utna hi doosri party stronger story bana sakti hai.
