Permanent Injunctions in Defamation Cases

Kisi ke khilaaf defamatory content – article, post, video – agar baar-baar publish ho raha ho, to sirf damages claim karna kaafi nahi lagta. Victim chah sakta hai ki court ek permanent injunction de, jisse future me bhi wohi jhooth phir se circulate na ho.

Lekin courts yahan thoda cautious rehte hain, kyunki free speech ka angle bhi hai. Pehle wo dekhte hain:

  • Kya defamatory statement clearly false hai,
  • Kya kisi valid defence (truth, fair comment, privilege) ka chance hai,
  • Kya defendant sirf harassment mode me repeat telecast kar raha hai.

Agar court ko lagta hai ki content obviously baseless hai aur reputation pe genuine long-term harm ho raha hai, to permanent restraint order mil sakta hai – jaise specific line/ video ko remove karna, dobara same allegation publish na karna, etc.

General blanket gag order (“is व्यक्ति ke bare me kuch bhi mat likho”) courts usually avoid karte hain. Targeted, narrow injunction hi constitutional balance ka better tareeka hai.
