Gated Communities and RWAs: Power Kitni, Limit Kya?

Large gated communities me Resident Welfare Associations (RWAs) ya societies daily affairs manage karti hain – security, maintenance, common facilities, vendor entry, etc. Residents kabhi-kabhi feel karte hain ki RWA mini-sarkar ban gaya hai.

RWA ke powers bye-laws, registration act, and resolutions se aate hain. Wo:

  • Maintenance charges fix kar sakta hai,
  • Rules bana sakta hai (noise, parking, pets, amenities),
  • Vendors ki access regulate kar sakta hai.

Lekin fundamental rights, discrimination laws, aur basic reasonableness ke against koi bhi rule valid nahi – jaise caste/ religion-based ban, visitors pe arbitrary harassment, ya private space me dress code.

Disputes ideally internal grievance mechanism, mediation, ya registrar ke through resolve hone chahiye. Litigation last step ho, warna community life toxic ho sakti hai.
