Hum sab judgments discuss kar sakte hain, disagree kar sakte hain, even sharply criticise kar sakte hain. Lekin jab criticism se court ki authority ya “administration of justice” ko direct hit lage, to criminal contempt ka danger aa jata hai.
Contempt do type ka:
- Scandalising the court – judges ko baselessly corrupt, biased, ya politically compromised bolna without any material,
- Obstructing justice – witness ko threaten karna, order ka open defiance, courtroom misbehaviour, etc.
Courts bolti hain ki power rarely use honi chahiye, par jab systematic campaign ya open disobedience ho, to action lena necessary hai.
Citizens, lawyers, journalists – sab ko yeh balance samajhna zaroori hai. Strong disagreement allowed hai; personal abuse, fake allegations, ya ongoing case ko derail karne wali publicity risk zone me aati hai.
